Information Requested:

I would be grateful if you could provide the internal guidance in which the panel are provided with to determine if an applicant will be able to proceed with financial redress.

For example, a specific number of years of prison sentence, whether someone is currently in prison, no rehab or amount of rehab, nature of offence ie domestic, kidnap, murder, rape – the panel must have a guidance in which they say yes or no to an application on the provided information.

Redress Scotland’s Response:

We have enclosed a copy of our Operation Guidance on previous convictions which is the internal guidance which the panel are provided to determine if an applicant will be able to proceed with financial redress. The Operation Guidance details how panels make decisions on applications of those who have serious convictions.
